Mission to Seafarers: Terms and Conditions

This website (“the Website“) is operated by The Mission to Seafarers (“MTSF“), a Registered Charity in England, Wales and Scotland (Registered Charity No: 1123613, Registered Charity (Scotland) No: SCO41938). MTSF is a company limited by guarantee, registered in England and Wales (Number: 6220240) with the registered address of 1st Floor, 6 Bath Place, Rivington Street, London EC2A 3JE.

Please note that by accessing and using the Website, you agree to be bound by our Terms and Conditions (“Terms“), as set out below. These shall take effect immediately from first use of the Website by an individual (“a User“) and continue to have effect thereafter.

The Terms may be updated at any time, so please check this page regularly. If you continue to use the Website we will assume that you accept these Terms as amended from time to time.

If you do not agree to these Terms, you must not use the Website.

1. Website Use

Users agree to use the Website for lawful purposes only and in a way that does not infringe the rights of or inhibit any other User’s use and enjoyment of the Website. Examples of prohibited behaviours include hacking, uploading viruses and transmitting obscene or offensive content.

2. Website Access

2.1 Withdrawal

Please note that MTSF reserves the right to suspend or withdraw access to the Website at any time and without notice. MTSF accordingly disclaims any liability in instances of temporary or indefinite unavailability of the Website.

2.2 Defects

MTSF does not warrant that the functioning of the Website will be uninterrupted or error free, that defects will be corrected, or that the Website or server are free of viruses or bugs. Users accept responsibility for implementing sufficient procedures and virus checks to satisfy their requirements.

3. Website Content

3.1. Information

The content of the Website is for the general information of Users and is indicative only. It is not intended to be a representation or advice on which Users should rely. Whilst MTSF has made reasonable efforts to check the accuracy of the Website, it may contain typographical or factual errors and inaccuracies for which MTSF shall accept no liability.

Please note that MTSF also reserves the right to amend any of the content listed or services offered by the Website at any time and without notice.

3.2. Intellectual Property

Unless otherwise stated, the MTSF owns the copyright in material on the Website. This material is accordingly protected by copyright laws and all rights are reserved.

Users may:

a) print off one copy, and download extracts of any page(s) from the Website for personal use; and/or

b) draw the attention of others within their organisation to content posted on the Website.

MTSF’s status (and that of any identified contributors) as authors of content on the Website must always be acknowledged.

Users may not:

a) modify the paper or digital copies of any materials printed or otherwise downloaded from the Website;

b) use any illustrations, photographs, graphics, video or audio sequences separately from any accompanying text; and/or

c) use any part of the content of the Website for commercial purposes without obtaining a licence to do so from MTSF.

If a User prints off, copies or downloads any part of the Website in breach of these Terms:

a) the right of that User to use the Website will cease immediately; and

b) the User must, at the option of MTSF, return or destroy any copies of the materials made.

4. Third Party Websites

From time to time, the Website may include links to other third party websites. These links are provided for the convenience of Users and for information only. MTSF:

a) does not endorse the content or views or such third party websites; and

b) is not responsible for the content of those websites, which Users will be deemed to be accessing under the terms and conditions of those third party websites.

5. Linking to the Website

Users may create a link to the home page of the Website, provided this is done in a way that is fair and legal and does not damage the reputation of MTSF or take advantage of it. In particular, Users must not establish a link:

a) in such a way as to suggest any form of association, approval or endorsement on the part of MTSF where none exists;

b) in any website not owned by that User; and/or

c) to any other page on the Website which is not the home page.

MTSF’s reserves the right to withdraw such linking permission without notice at any point.

6. General Overarching Disclaimers

6.1 Disclaimers

The Mission to Seafarers disclaims:

a) all warranties whether express or implied;

b) any liability for any direct, indirect, incidental, consequential loss of business profits or special damages arising from material on the Website; and

c) any liability for error or omission in respect of the content of the Website.

6.2 Severability

If any of the provisions of these Terms are determined to be illegal, invalid or otherwise unenforceable, it shall be severed and deleted and the remaining provisions of these Terms shall survive and continue to be binding and enforceable.

7. Jurisdiction

If you are an individual, please note that these Terms, their subject matter and their formation, are governed by English law. The courts of England and Wales shall have exclusive jurisdiction, except if you are a resident of Northern Ireland, in which case you may also bring proceedings in Northern Ireland, and if you are resident in Scotland, in which case you may also bring proceedings in Scotland.

If you are a business, these Terms, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. The courts of England and Wales shall have exclusive jurisdiction.
